FTC and DOJ Expand Labor Market Review

The Federal Trade Commission (FTC) and the Department of Justice Antitrust Division (DOJ) have signed a new memorandum of understanding (MOU) with the Department of Labor and the National Labor Relations Board (NLRB) to bolster their ability to evaluate the impact of mergers and acquisitions on labor markets. This agreement expands existing collaborations by formalizing the sharing of information and expertise between these agencies. The MOU will facilitate the prompt exchange of technical assistance and data from the labor agencies to the antitrust agencies and include training sessions to enhance understanding of labor market issues.

FTC Chair Lina M. Khan and DOJ Antitrust Division Assistant Attorney General Jonathan Kanter emphasized that this enhanced partnership aims to ensure competitive labor markets, which are essential for improving wages and working conditions. Acting Secretary of Labor Julie Su and NLRB General Counsel Jennifer Abruzzo also highlighted the importance of this cooperation in protecting workers and promoting fair competition. The MOU builds on previous agreements and reflects a commitment to a coordinated approach in scrutinizing the labor-related effects of corporate mergers and acquisitions.
