OpenAI Moves to Dismiss Trade-Secret Lawsuit by xAI

OpenAI asked a federal judge to dismiss a lawsuit filed by xAI, run by Tesla CEO Elon Musk, which alleged that OpenAI lured employees away to steal trade secrets. The filing, submitted to the U.S. District Court for the Northern District of California, San Francisco Division, described the lawsuit as an attempt to intimidate OpenAI and “distract from the failures of [Musk’s] own competitive AI effort.” OpenAI stated that “the truth is that xAI is hemorrhaging talent to other competitors, including OpenAI,” emphasizing that the departure of employees was part of normal competitive hiring rather than misappropriation of trade secrets.

The legal dispute is the latest in a series of clashes between Musk and OpenAI, reflecting ongoing tension over OpenAI’s shift toward a for-profit model. xAI filed the suit in late September, claiming former employees took confidential information related to its Grok project and provided it to OpenAI. Separately, xAI has also sued Apple and OpenAI, alleging an “anticompetitive scheme” to undermine AI rivals, though both companies have denied the claims and sought dismissal. OpenAI’s move signals the company’s intent to challenge the allegations and defend its hiring practices within the competitive AI sector.
