NLRB Acting General Counsel Revokes Predecessor’s Memos, Signals Policy Shift

NLRB Acting General Counsel William B. Cowen has issued a memorandum rescinding several policies introduced by his predecessor and announced plans to provide further guidance on the agency’s resource allocation. In his statement, Cowen acknowledged the increasing workload and backlog of cases, emphasizing the need to focus on achievable goals. He noted that attempting to address all issues simultaneously could hinder progress. Among the rescinded memos are those related to remedies, student-athlete rights, electronic monitoring, severance agreements, and non-compete agreements. Additionally, Cowen plans to issue further guidance on the National Labor Relations Board’s (NLRB) decision in the Cemex Construction Materials Pacific, LLC case.

Cowen also rescinded a memo on mail ballot elections, citing the end of the COVID-19 federal public health emergency as the reason for its removal. The NLRB, established in 1935, plays a key role in protecting employees from unfair labor practices and ensuring their right to organize. The agency conducts workplace elections and investigates labor disputes across the private sector. Cowen’s actions signal a shift in policy direction, with further guidance expected to clarify the agency’s priorities and approach to labor relations.
